PRIVACY POLICY
LIABILITY, INDEMNITY, AND ARBITRATION
We understand how important your privacy is. This Privacy Policy outlines how we collect, use, maintain, and safeguard your Personal Information collected via the Site.
1. Consent and Collection of Information
Personal Information defined: This means information about an individual whose identity is apparent or can be reasonably ascertained (such as your name, email address, phone number, birthday, billing address, or contact details).
Consent: By submitting Personal Information to us, our Site, or our service providers, you consent to its collection, use, and disclosure in accordance with this Privacy Policy. You may refuse or withdraw your consent at any time by emailing us, though doing so means we may no longer be able to offer our services or information to you.
2. Biometrics & Progress Tracking
Wellness Tracking Data: We may collect and store basic biometric data, including height, weight, calculated BMI, and before-and-after photographs, for the express purpose of tracking your somatic fitness progress, tailoring personalized training programs, and evaluating the effectiveness of our services.
Data Security & Media Release: This information will be handled with reasonable security measures and retained only as long as necessary. With your explicit permission and a separately signed Media Release Agreement, before-and-after photographs may be used for promotional or inspirational purposes. You can refuse to provide this info, but it may limit our ability to provide fully personalized services.
3. How We Use Your Personal Information
Your information is processed to deliver the products, newsletters, and services you purchase or subscribe to. Specifically:
Financial Information: Your credit card details are never kept or stored by us; they are held securely by integrated third-party payment gateways (e.g., Stripe, PayPal).
Marketing Communications: If you subscribe to our newsletter, we will send you emails about promotions, special events, and updates. You can opt out at any time by clicking “unsubscribe” at the bottom of the email or sending a direct email request.
Phone Contact: If you share your phone number, it will be securely stored in a password-protected contact database. We may use it to reach out if there is information we feel would directly benefit you, but it will never be shared with third parties without your permission.
Legal Disclosures: We may share your information if required in good faith to protect your safety or the safety of others, investigate fraud, respond to a legitimate government or legal request, or comply with the law.
Data Deletion: We will NEVER sell or license your Personal Information. We will be happy to delete any of your Personal Information that we hold upon a written request made by you.
4. Third-Party Applications & Security Limitations
Third-Party Privacy: We work with external applications to provide you with seamless service (such as hosting platforms, email software, and processors). These organizations collect required data from you independently.
Links to their respective privacy policies can be requested from us to ensure your comfort. We are not liable for any data disclosure or privacy practices mishandled by these third parties.
The Internet Can Be Unreliable: We adopt strong security measures (including password-protected servers and computers) to safeguard your data against loss, theft, or unauthorized access. However, the internet is inherently open and subject to data interception; we cannot fully guarantee that info will not be intercepted outside of our direct control.
5. Cookies, Analytics, and Trackers
Analytics: The Site keeps track of anonymous data from your visits (visit times, layout interactions, and IP information) exclusively to improve server security and customer engagement.
Cookies: The Site uses "cookies"—small text files sent to your hard drive—to remember your preferences and keep track of your visits. No Personal Information is stored in the cookie itself. Your continued use of the Site serves as consent for cookies. You can adjust your web browser settings to disable cookies, though it may render some features unusable.
Do Not Track Signals: We currently do not recognize or respond to browser-initiated Do Not Track (DNT) signals, as there is no uniform industry standard on how to process them.
6. Children Under 18
The Site is not intended for children under 18 years of age, and we do not knowingly collect personal details from minors. If we learn we have received information from a child under 18 without verified parental consent, we will delete that information immediately. Please contact us if you suspect such information has been shared.
1. Limitation of Liability & Indemnity
Limitation of Liability: In no event shall Gillian Reid Tao or her affiliates be liable for any damages (including, without limitation, direct or indirect damages for physical injury, emotional distress, health complications, loss of data or profit, or business interruption) arising out of the use, implementation, or inability to view or use the materials, content, or somatic techniques taught on the Site.
Indemnity: As a condition of your use of this Site and its Services, you agree to indemnify and hold harmless Gillian Reid Tao and her associates, directors, and affiliates from and against any and all liabilities, expenses (including legal fees), and damages arising out of claims resulting from your use of this Site or violation of this Agreement.
2. Dispute Resolution: Binding Arbitration
Arbitration Clause: Any controversy or claim arising out of or relating to this Agreement, or the breach of this Agreement, shall be settled exclusively by binding arbitration.
Terms of Arbitration: The parties agree to irrevocably submit all claims to the exclusive jurisdiction of the courts designated below, or such other independent arbitrator mutually agreed upon by the parties. The arbitrator’s decision shall be final, non-appealable, binding on both parties, and enforceable in any court of competent jurisdiction.
Costs: The costs of the arbitration process shall be borne entirely by the losing party. This arbitration clause shall explicitly survive the termination or expiration of this contract.
3. Governing Law & Jurisdiction
Choice of Law: This Agreement, the use of the Site, and the Privacy Policy are governed by and construed in accordance with the laws of Italy / the European Union (or the primary corporate registry jurisdiction of the practitioner), without regard to conflict of law provisions.
Venue: The parties agree to irrevocably submit all claims relating to the Site or Services to the exclusive jurisdiction of the local courts of that designated jurisdiction.
4. Severability & Entire Agreement
Entire Agreement: These Terms and Conditions, Privacy Policy, and linked legal guidelines constitute the entire agreement between you and us relating to your use of this Site, superseding all prior understandings, representations, or agreements (whether oral or written). This Agreement may not be amended or modified except by us.
Severability: If any provision of these Terms is found by a court of competent jurisdiction to be unenforceable, that specific portion shall be enforced to the maximum extent permissible so as to effectuate the intent of the parties, and the remainder of these Terms and Conditions shall continue in full force and effect.
No Waiver: Failure by us to enforce or exercise any provision of these Terms shall not constitute a waiver of that right. Paragraph headings are utilized for reference purposes only.
